Eat Mostly Greens (“EMG”, “we”, “us”, “our”)

By accessing our website, booking services, enrolling in programs, or using any EMG services, you agree to these Terms & Conditions.

1. Nature of Services

EMG provides evidence-based nutrition counseling, medical nutrition therapy (MNT), telehealth consultations, wellness coaching, group programs, educational resources, and related services.

Our services are intended to support health and nutrition goals and are not a substitute for medical diagnosis, treatment, or emergency care.

2. Medical Disclaimer

• EMG is not an emergency medical service.
• Services do not replace care from your physician or healthcare provider.
• No physician-patient relationship is created through general educational content.
• Clients are responsible for consulting their healthcare provider regarding medical conditions, medications, and treatment plans.

If you are experiencing a medical emergency, call local emergency services immediately.

3. Telehealth Consent

By using EMG services, you consent to receive care via telehealth platforms, including video, audio, messaging, and electronic communication.

You acknowledge:

• Technology may fail or interrupt sessions
• Privacy risks exist in electronic communication
• You are responsible for ensuring a private, secure environment during sessions

4. HIPAA & Privacy Statement

EMG complies with applicable privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA), where applicable.

We may collect and use protected health information (PHI) for:

• Nutrition assessment and counseling
• Treatment planning
• Insurance billing and verification
• Scheduling and communication

We implement reasonable administrative, technical, and physical safeguards to protect your information.

By using our services, you consent to the collection and use of your information for the purposes listed above.

5. Insurance Coverage (NY, NJ & Other Applicable States)

EMG may accept insurance in select states, including New York and New Jersey, depending on eligibility and payer participation.

Important:

• Insurance coverage is not guaranteed
• Verification of benefits is not a guarantee of payment
• Clients are responsible for all amounts not covered by insurance, including:
  • Copays
  • Deductibles
  • Coinsurance
  • Denied claims
  • Non-covered services

If insurance denies a claim, the client agrees to be responsible for the self-pay rate.

6. Payment Terms

• Payment is due at the time of booking unless otherwise stated
• EMG reserves the right to suspend or discontinue services for unpaid balances
• Clients are responsible for ensuring valid and up-to-date payment/insurance information

7. Cancellation & No-Show Policy

• Cancellations must be made at least 24 hours in advance
• Late cancellations (less than 24 hours) will be charged the full session fee
• No-shows are charged in full
• Repeated missed appointments may result in termination of services

8. Program Participation & Conduct

EMG reserves the right to remove any client from services, programs, or group environments without refund if the client:

• Engages in abusive, disrespectful, or disruptive behavior
• Violates program guidelines
• Creates an unsafe environment for staff or participants
• Misuses services or communication channels

9. Results Disclaimer

Individual results vary.

EMG does not guarantee:

• Weight loss or weight gain outcomes
• Medical improvements
• Laboratory changes
• Insurance reimbursement outcomes

Outcomes depend on multiple factors including adherence, medical history, and individual variability.

10. Intellectual Property

All EMG content is protected, including:

• Meal plans
• Educational materials
• PDFs
• Videos
• Program frameworks
• Website content

You may not copy, reproduce, distribute, or resell any materials without written permission.

11. Third-Party Services

EMG uses third-party platforms for:

• Scheduling
• Telehealth
• Payment processing
• Insurance billing

We are not responsible for outages, errors, or data issues caused by third-party platforms.

12. Limitation of Liability

To the fullest extent permitted by law, EMG is not liable for:

• Health outcomes
• Indirect or consequential damages
• Loss of income or opportunities
• Third-party system failures

Total liability is limited to the amount paid for services.

13. Indemnification

You agree to hold harmless EMG, its practitioners, contractors, and affiliates from any claims arising from your use of services.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States and Islamic Republic State of Pakistan.

We may update these Terms at any time. Continued use of services indicates acceptance of updates.
